1. The service
Encore Bon lets food shops in Luxembourg offer the day’s unsold products as surprise bags, and lets individuals reserve them and pick them up in store. The service is free for customers.
2. Reserving (customers)
A reservation requires a first name and a valid email address. It covers 1 or 2 bags at most, subject to availability. A 6-character pickup code is shown and emailed to you.
The content of the bag is a surprise: it depends on what didn’t sell. The value shown is the shop’s estimate.
3. Price and payment
The price is set by the shop, all taxes included. It is paid directly to the shop at pickup, using the payment methods it accepts. Encore Bon receives no payment from customers.
4. Pickup, cancellation and no-shows
The bag is picked up during the stated window, on presentation of the code. Cancellation is free and is done from the link in the email, until the window starts.
A bag neither collected nor cancelled counts as a no-show. After 2 no-shows within 60 days, reservations are paused for 30 days for the same email address or phone number.
Foodstuffs liable to deteriorate rapidly are excluded from the right of withdrawal under the Consumer Code.
5. Allergens and food safety
The shop alone is responsible for the quality, hygiene and safety of the products, and for information about allergens, which it provides in store. If you have an allergy or special diet, ask at the counter before paying.
6. Shops: joining and publishing
A shop joins Encore Bon by application. Once approved, it receives personal access to its area. It undertakes to describe its bags honestly, state a realistic value, respect the published windows and hand over reserved bags.
A region opens to the public only once 5 shops are active.
7. Shops: fees and billing
The fee is €1.49 per bag actually collected. No-shows and cancellations are never billed. There is no subscription and no sign-up fee.
“Founding partner” offer: no fees for 12 weeks from the day the shop’s account opens, for the first 20 partner shops.
A monthly statement, which serves as an invoice, is issued at the start of each month for the previous month. It is payable by bank transfer within 15 days. Petite entreprise bénéficiant du régime de franchise de TVA — TVA non applicable.
8. Duration and termination
The partnership has no minimum term. The shop can stop at any time, without notice; fees for bags already collected remain due. Encore Bon may suspend a shop that does not comply with these terms.
9. Personal data
Data processing is described in the privacy policy.
10. Governing law
These terms are governed by Luxembourg law. Failing an amicable settlement, the courts of Luxembourg City have jurisdiction, subject to consumer protection rules. Contact: hello@encorebon.lu.
Items in square brackets will be completed as soon as the official numbers are issued. In case of discrepancy, the French version prevails.
